1. Acceptance of Terms
By accessing our website or engaging Fincodev for any service, including web development, SEO, social media marketing, CRM automation, or custom software, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.
2. Services Provided
Fincodev offers website and app development, search engine optimization, social media marketing, GoHighLevel CRM automation, custom web/app and CRM builds, and ongoing website maintenance. Exact scope, deliverables, and pricing for each engagement are outlined in the client's individual proposal, quote, or package selection.
3. Project Scope and Revisions
Each service package includes a defined scope and number of revision rounds, as listed on our pricing page. Requests outside the agreed scope, including new features requested after prototype approval, will be treated as additional work and billed separately as outlined in our add-on pricing.
4. Payment Terms
A deposit is required before work begins on any project, with the balance due on completion or per the milestone schedule agreed in writing. Monthly subscription services are billed in advance on a recurring basis. Late payments may result in a pause of ongoing work or service suspension until the account is settled.
5. Intellectual Property
Upon full payment, ownership of final deliverables (website files, designs, custom code) transfers to the client, except for any third-party assets, licensed software, or pre-existing Fincodev tools and frameworks used in development, which remain the property of their respective owners. Fincodev retains the right to showcase completed work in its portfolio unless otherwise agreed in writing.
6. Client Responsibilities
Clients are responsible for providing timely feedback, content, and access credentials required to complete the project. Delays caused by the client may extend project timelines accordingly.
7. Third-Party Tools and Platforms
Some services rely on third-party platforms such as GoHighLevel, WordPress, Shopify, or WooCommerce. Fincodev is not responsible for downtime, pricing changes, or policy changes made by these third-party providers.
8. Cancellation and Refunds
Deposits are non-refundable once work has commenced. Monthly subscription services can be cancelled with 14 days' written notice; fees already paid for the current billing cycle are non-refundable.
9. Limitation of Liability
Fincodev is not liable for indirect, incidental, or consequential damages arising from the use of our services, including loss of revenue, data, or business opportunities, beyond the total amount paid for the specific service in question.
10. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement, except where disclosure is required by law.
11. Governing Law
These terms are governed by the laws of Pakistan. For clients based in the UK, EU, US, or UAE, any disputes will first be addressed through good-faith negotiation before pursuing formal legal action.
12. Changes to These Terms
Fincodev reserves the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms.
